（略）（下称“征集人”）（略）（下称“征集代理”），就“（略）”（略）（四川）总部项目（以下简称“（略）”）组织创意征集活动，拟面向全球公开邀请具有相关商业规划和商业综合体建筑设计经验的申请人前来应征。本次征集将通过公开资格预审的方式：（略）
SichuanSilkRoadPortConstruction&DevelopmentCo.,Ltd.(hereinafterreferredtoasthe“Solicitor”)andShanghaiInternationalTenderingCo.Ltd.(hereinafterreferredtoasthe“SolicitationAgent”)arenowsolicitingproposalsforbusinessplanningandcreativeideaofarchitecturalconceptoftheBeltandRoadInitiativeImport&ExportCommodityDistributionCentre(SICHUAN)HeadquarterProject(hereinafterreferredtoasthe“DistributionCentreProject”).（略）,planninganddesignconditions,andbuildingscale,soastoprovidescientificandreasonableadviceforSolicitortocarryoutthepublicbiddingofdesignandconstructionofthisproject.ThissolicitationdoesnothaveadirectcausalrelationshipwiththeundertakingofthedesignandconstructionworkoftheDistributionCenterProject.

一、征集背景/TheBackgroundofSolicitation
“（略）”（略）项目，是省委省政府贯彻落实总书记关于建设成（略）双城经济圈和来川视察时提出的“构筑向西开放战略高地和参与国际竞争新基地，尽快成为带动西部高质量发展的重要增长极和新的动力源”要求，紧紧围绕“以共建‘（略）’为引领，加大西部开放力度”的战略方向，直接规划实施的重大项目。项目承担了建设内陆国际门户枢纽、创建创新型开放（略）、成为开放型经济发展新引擎的重要使命，体现了党中央国务院对成（略）打造内陆型开放高地的殷切希望。（略）落实中央及省委、省政府决策部署，着眼成（略）双城经济圈建设需要，立足集团打造四川开放型经济重要载体的标志性项目。其整体概念创意具有较高的国际性、开放性和标识性作用，高度体现“（略）”国际特色。
TheDistributionCentreProjectisaninitiativeputforwardbySichuanProvincialPartyCommitteeandProvincialGovernmenttoimplementthevisionofPresidentXiforbuildingChengdu-ChongqingEconomicCircleonhisvisittoSichuan.PresidentXicallsfor"theconstructionofastrategichighlandforopeninguptothewestandanewbaseforparticipatingintheinternationalcompetition,andtobecomeanimportantgrowthpoleandnewdrivingforceforhigh-qualitydevelopmentinthewesternregionassoonaspossible".TheDistributionCentreProjectisamajoractionplannedandimplementedinthestrategicdirectionof“jointlybuildingtheBeltandRoadInitiativeandstrengtheningtheopeningupofthewest”.Astheonlyexport-orientedstrategicprojectdirectlyplannedbytheCPCCentralCommitteeandtheStateCouncil,theDistributionCenterProjecthasundertakentheimportantmissionofbuildinganinlandinternationalgatewayhub,creatinganinnovativeandopendemonstrationzone,andbecominganewengineforopeneconomicdevelopment,anditreflectstheardenthopeoftheCPCCentralCommitteeandtheStateCouncilforChengduandChongqingtobuildaninlandopening-（略）,andaimstobuildanimportantcarrierofSichuan'sopeneconomy.TheDistributionCenterProjectshouldplayasymbolicrole,reflectingtheinternationalcharacteristicsoftheBeltandRoadInitiative.

二、征集程序/TheProceduresofSolicitation
1.资格预审/Prequalification
征集人和征集代理将组建资格预审评审委员会，对按时提交了资格预审《申请文件》的应征申请人进行资格审查和详细评审，通过两阶段详细评审择优选取3位应征人参加征集活动。
第一阶段详细评审：资格预审评审委员会通过记名投票法从通过资格审查的申请人选出10位候选人进入第二阶段详细评审。
第二阶段详细评审：征集人和征集代理将组织10位候选人参加汇报和交流会。资格预审评审委员会将根据现场汇报和交流情况，通过打分法确定3位候选人作为正式入围应征人，并通过记名投票法从剩余的7位候选人中选出2位候选人作为备选应征人。当正式入围的应征人无法参加征集时，征集人可根据备选应征人的排名，依次选择备选应征人增补。征集人保留不增补的权利。
详细的评审方法参见《资格预审文件》第二章“资格预审须知”第9条。
TheSolicitorandtheSolicitationAgentwillsetupaPrequalificationEvaluationCommitteetoconductqualificationreviewandevaluationonapplicantswhohavesubmittedtheprequalificationAPPLICATIONDOCUMENTontime.ThreeParticipantswillbeselectedthroughtworoundsofevaluation.
Firstroundofevaluation:PrequalificationEvaluationCommitteeselects10candidatesfromtheapplicantswhohavepassedthequalificationreviewviaopenballottoenterthesecondroundfordetailedevaluation.
Secondroundofevaluation:TheSolicitorandtheSolicitationAgentwillholdapresentationand
exchangesession,basedonwhichthePrequalificationEvaluationCommitteewilldetermine3candidatesasofficiallyshortlistedParticipantsthroughscoringmethod.Fromtheremaining7candidates,2willbeselectedasalternativeParticipantsviaopenballot.WhenanofficiallyshortlistedParticipantisunabletoparticipateinthesolicitation,theSolicitormayselectanalternativeParticipanttobeaddedaccordingtotheranking.TheSolicitorreservestherightnottomakeadditions.

2.《应征文件》的评审/EvaluationofPROPOSAL
应征文件评审委员会由征集人代表和相关专业的专家组成。评审委员会将对3位应征人提交的《应征文件》的内容进行综合评比，并对3位应征人进行排序。

征集人将根据评审委员会确定的征集结果，向3位应征人发出征集结果通知。

5.征集内容和《应征文件》成果要求/TheContentsofSolicitationandRequirementsofPROPOSAL
（1）商业规划部分：内容应包括但不限于项目背景分析、区域产业研究、区域（略）内场景建议、招商及运营建议、财务测算模型等内容。成果形式为电子文件（PDF或PPT格式）以及纸质文本。

（2）建筑概念创意部分：内容应包括但不限于项目愿景、概念创意亮点及特色、表现概念创意的各类效果图和分析图（含鸟瞰图、临街人视点建筑透视图、室内外透视图、立面效果、色彩展示、屋顶绿化、总平图、主要平立剖展示、交通组织分析、空间形态分析等）、经济技术指标及投资估算等。成果形式为纸质文本、5分钟的多媒体演示文件（含不少于2分钟的动画）、展板、1:500实体模型、电子文件（含所有创意说明、技术图纸和3D模型）。

六、申请人的资格要求/EligibilityandQualificationsRequirements

4.1本次征集内容主要包含商业规划和建筑概念创意。申请人可根据自身需求选择单独或以联合体的形式参加资格预审。
Thissolicitationismainlyfocusedonbusinessplanningandarchitecturalconceptcreation.Applicantsmaychoosetoparticipateintheprequalificationindividuallyorintheformofaconsortiumaccordingtotheirneeds.
4.2如果以联合体形式参加资格预审，联合体所有成员均须满足上述第1条的资格要求，并根据各自承担的工作内容满足上述第2条和第3条对应的资格要求。联合体的成员数量不限制。
Incaseofparticipatingintheprequalificationintheformofaconsortium,allmembersoftheconsortiumshallmeetthequalificationrequirementofClause1inSection6andthecorrespondingqualificationrequirementsofClause2andClause3inSection6accordingtothecontentoftheworkundertakenbyeachofthem.Thereisnolimittothenumberofmembersoftheconsortium.
4.3联合体的组成以提交的资格预审《申请文件》为准。联合体各方不得再以自己名义单独参与本次征集活动，也不得同时加入参与本次征集活动的其他联合体，否则，相关《申请文件》均被否决。

4.4联合体的各成员应共同签署一份联合体协议，协议需明确各成员单位：（略）

资格预审《申请文件》应以电子文件和纸质文件的形式提交。提交截止时间为2024年7月22日中午12:00时，提交的时间以电子文件上传成功的时间为准。除了在截止时间前成功上传的《申请文件》外，未在截止时间前上传或以其他形式提交的《申请文件》一律不被受理。

经评审委员会评定其《应征文件》符合《征集文件》要求，并被征集人确定为排名第一的应征人将获得征集费人民币150万元（含税）；排名第二名的应征人将获得征集费人民币120万元（含税）；排名第三名的应征人将获得征集费人民币100万元（含税）。
TheevaluationcommitteewillevaluatePROPOSALoftheParticipants.IfitmeetstherequirementsofSOLICITATIONDOCUMENT,theParticipantranks1stwillreceiveasolicitationfeeofRMB1,500,000.00(taxincluded);theParticipantranks2ndwillreceiveasolicitationfeeofRMB1,200,000.00(taxincluded);andtheParticipantranks3rdwillreceiveasolicitationfeeofRMB1,000,000.00(taxincluded).
2.当应征人出现下列情况时，征集人不予支付征集费：
UnderthefollowingcircumstancestheSolicitorareentitledtorefusetopaythesolicitationfee:
2.1应征人未按规定时间递交完整的《应征文件》的；
PROPOSALisnotsubmittedontimeandcompletely;
2.2应征人递交的《应征文件》被评审委员会认定为未对《征集文件》的要求作出实质性的响应；
PROPOSALisdeterminedbytheevaluationcommitteenottobeasubstantialresponsetotherequirementsofthesolicitationdocument;
2.3征集期间，应征人的资格条件发生变化，不能达到上述第六条规定的资格要求，被取消应征人资格；

2.4征集期间，应征人未经征集人书面同意，擅自更换主要创作人员的。

3.以上征集费已含中国境内、外应缴纳的各项税费。

十一、其它条款/OtherTerms
1.知识产权/IntellectualPropertyRights
1.1应征人承诺其拥有其提供服务时编制的所有图纸、说明、电子文档和其它相关文件的合法权利和知识产权。
AllParticipantpromisesthatithasthelegalrightsandintellectualpropertyrightsofalldrawings,descriptions,electronicdocumentsandotherrelevantdocumentspreparedwhenitprovidesservices.
1.2应征人应保证递交的成果在中国境内或境外没有且不会侵犯任何其他人的知识产权（包括但不限于著作权、专利权）或专有技术或商业秘密。应征人应保证，如果其成果使用或包含任何其他人的知识产权或专有技术或商业秘密，应征人已经获得权利人的合法、有效、充分的授权。应征人因侵犯他人知识产权或专有技术或商业秘密所引起的全部赔偿责任应由应征人承担。
ParticipantshallensurethatthesubmittedproposalhasnotinfringeduponandwillnotinfringeuponIPR(includingbutnotlimitedtocopyrightandpatents)orproprietarytechnologiesortradesecretsofotherswithinoroutsidethePeople’sRepublicofChina.ParticipantshallguaranteethatifhisproposalusesorincludesIPRorproprietarytechnologiesortradesecretsofothers,Participantshallhavealreadyobtainedlegitimate,validandsufficientauthorizationfromtherightholders.ParticipantshalltakeallliabilitiesarisingfrominfringementbytheParticipantuponIPRorproprietarytechnologiesortradesecretsofothers.
1.3在征集过程中征集人提供的基础资料的知识产权属征集人所有。应征人仅可以将上述文件用于编制《应征文件》之目的。未经征集人书面许可，应征人不得将上述文件用于其他咨询设计或其他目的，也不得将上述文件泄露给任何第三方。

2.适用法律/GoverningLaws
本次征集活动本身及与本次活动相关的文件所适用的法律和法规仅为中华人民共和国的法律和法规。

3.语言/Languages
《资格预审文件》使用中文和英文书写。在中、英文两种语言的意思表达不一致时，以中文为准。资格预审《申请文件》、与征集人和征集代理之间的往来函电和文件均应使用中文书写。申请人随《申请文件》提供的证明文件和印刷品可以使用另一种语言，但必须附以中文译本。
ThePrequalificationDocumentshallbewritteninbothChineseandEnglish.IntheeventofanydiscrepancybetweenthemeaningsexpressedintheChineseandEnglishlanguages,theChineselanguageshallprevail.TheAPPLICATIONDOCUMENTforPrequalification,correspondenceanddocumentsrelatedtothissolicitationwithParticipantsandtheSolicitorandSolicitationAgentshallbewritteninChinese.SupportingdocumentsandprintedmaterialsthatParticipantsprovidealongwiththeAPPLICATIONDOCUMENTmaybeinanotherlanguage,butmustbeaccompaniedbyaChinesetranslation.
4.解释权/RightofInterpretation
本次征集活动及相关文件的最终解释权归征集人所有。
